The Kentucky Commission on Human Rights Has Opportunities To Improve Its Fair Housing Complaint Intake Process

We audited the Kentucky Commission on Human Rights’ fair housing complaint intake process.  We initiated this audit based on an internal risk assessment of Fair Housing Assistance Program agencies’ challenges.  Our audit objectives were to (1) determine the extent to which the Commission processed fair housing inquiries within 30 days and (2) evaluate its reasons for closing fair housing inquiries.

Housing Authority of the City of Gary Section 8 Housing Program, Gary, IN

We audited the Housing Authority of the City of Gary's (Authority) Section 8 housing program. The audit was part of the activities in our fiscal year 2005 annual audit plan. We selected the Authority based upon a risk analysis the identified it as having a high risk Section 8 housing program. The objective of the audit was to determine whether the Authority managed its Section 8 program in accordance with the U.S. Department of Housing and Urban Development's (HUD) requirements.

HUD and FHAP Agencies Can Better Document Decisions Not to Investigate Fair Housing Complaints

Develop a process to oversee housing discrimination allegations that FHAP agencies close and do not submit to HUD for dual-filing to ensure that the closure and jurisdictional determinations are consistent with the Fair Housing Act. To help address this recommendation, HUD should consider requiring FHAP agencies to enter data on closed inquiries in HEMS and make updates to FHAP agreements as necessary.

HUD and FHAP Agencies Can Better Document Decisions Not to Investigate Fair Housing Complaints

Update HUD Handbook 8024.01, REV-2, and regional intake policies and procedures as necessary to include (1) minimum requirements that all regions follow for documenting in HEMS attempts to reach out to claimants when additional information is needed before closing inquiries; (2) policies and procedures for collecting, recording, and documenting all relevant electronic intake information in HEMS; and (3) clarifying that communications with claimants regarding inquiry closure, requests for additional information, and notices of jurisdiction information clearly inform the claimant
